What is my risk if I don’t do background checks?

The cost to a company in making a bad hiring decision can be very damaging both monetarily and to a company’s reputation. Hiring a bad employee can result in lost training expense, negligent hiring lawsuits, and termination lawsuits. Performing an adequate background check is an important process in showing due diligence if a negligent hiring lawsuit arises.

Should I do the same screen for everyone?

The type of screen that is performed doesn’t have to be the same for everyone. You may choose to perform more detailed screens based on the applicant’s level of responsibility. However, all applicants for the same position should receive the same screen.

Can I do background checks on anyone?

Background checks can only be performed for purposes outlined in the Fair Credit Reporting Act. In addition, the employer must provide a disclosure statement to the applicant that a background investigation will be performed and obtain a written release form from the applicant to conduct the investigation.

Is this industry regulated?

Companies that conduct Pre-Employment Screening must comply with the requirements of the Fair Credit Reporting Act (ACT) as well as other Federal and State laws.

How do I know you are a reliable company to use for background checks?

Background Data has implemented a compliance program which operates within the requirements of the Fair Credit Reporting Act as well as Federal and State laws. In addition, our company is a member of the National Association of Professional Background Screeners which provides a code of ethics and best operating practices for the screening industry. It is important to check if your screener is a member of this organization.

How soon will I get the results back after I order a search?

The background search is usually completed within two to three business days. Some searches which involve physically going to a courthouse or verifying past employment or education may have delays out of our control such as waiting for returned phone calls, or schools and courthouses closed for holidays.
